Do I need a licence?
If you store petroleum spirit (petrol) in a tank, which is dispensed in to a
motor vehicle's tank then you will almost certainly need a
licence to do so. (There are one or two exceptions to this rule. These relate to
storage for use in motor vehicles or other internal combustion engines –
contact us for more details).
I need a licence, now what do I do?
You can either contact
us to request an application pack, or you can download
a form to complete and return to us at:

This should be completed and returned, along with copies of drawings of your
premises (scale 1:100), showing the proposed location and storage arrangements
for storage of petroleum. The design should comply with the principles of the
Design, Construction, Modification, Maintenance and Decommissioning Of Filling
Stations (2nd edition ISBN 0 85293 419X).
We will consider the application once we have received all relevant
information and advise you of the outcome, and any fee needed for the licence.

All fees for a petroleum licence are payable per annum.

Licence conditions
A licence is issued subject to strict
conditions containing important safety requirements, which must be followed. A
copy of the conditions will accompany your licence. The licence must be kept
available on the premises in a site register.
Information requests
The Trading Standards Service hold historical records of tanks previously
licensed for the storage of petroleum spirit. Information regarding specific
tanks and the methods used for making them safe from the danger of fire or
explosion can be disclosed on written request. The disclosure is subject to
payment of a reasonable fee.

The Poisons Act 1972
Controls the sale of poisons,
and
Provides for registration
of sellers of poisons.
The Poisons Act 1972 and the Poisons
rules 1982 prohibit the sale of poisons unless the seller is a retail pharmacist
or a person who has his name on the local authority's list entitling him to sell
poisons from the premises named (a listed seller).
Listed sellers can not sell poisons
which are included in Part I of the Poisons List. These may only be sold by a
pharmacist.
A listed seller or their named deputy is
authorised to sell the poisons named in Part II of the Poisons List subject to
certain conditions.
Each listed seller is required to keep a
Poisons Book in which certain information relating to each sale of a poison must
be entered before delivery to the purchaser.
Fees must be paid to the local authority
be persons wishing to have their names on the list.
