Restricted Sales
- Information on what goods can and cannot be sold to
young people
- Arbitration
- a
form of Alternative Dispute Resolution whereby the dispute is entrusted
to one or more third parties rather than the court. The arbitrator must
apply the law accurately and can adopt a form of procedure that appears
to be appropriate. The arbitrator's decision is final unless the
arbitrator has not conducted himself properly or there is a right of
appeal on a question of law, but only with consent of both parties or
with leave of the court.

Balance
of Probabilities - The standard of proof in
civil cases (see civil law). When a person goes to court regarding a
consumer matter, the Judge listens to both the consumer's argument and
the trader's argument, weighs up the evidence and decides which
version is probably true. This is the kind of decision which is
represented by the scales of justice. If the scales tip slightly in
one party's favour then on the 'balance of probabilities' that party's
argument is more believable/true than the other party.
- Bankruptcy
- When a person is declared bankrupt, this is the name of the
proceedings which takes place to declare that person a bankrupt and to
have that person's property administered for the benefit of his
creditors.
- Breach of
Contract - When a party to a contract refuses or
fails to fulfil an obligation imposed on them under that contract.
- British
Wood Preserving and Damp-proofing Association, The - The
nationally recognised authority on timber and damp problems, the BWPDA
deals with all the relevant government departments and remains at the
forefront of developments in this areas. Members work to an
OFT-approved Code of Practice and must regularly demonstrate that
these standards are being maintained. The association operates an
Arbitration Scheme in the event of a complaint arising.

Cancellation
- To withdraw from an agreement or contract. Sometimes you can cancel
a contract if the other party is in breach of the agreement, i.e. they
have misrepresented the goods or services, or supplied faulty goods.
Sometimes, the law gives automatic rights to cancel within a certain
period of time, called a 'cooling-off' period. Legal rights to cancel
include contracts made 'at a distance' (by internet, phone or mail
order), goods or services bought as a result of an unsolicited or
uninvited visit to the home, or credit agreements signed at home. At
other times, the contract terms themselves may give you rights to
cancel, so always read them carefully
