It is not permitted to allow an unfit horse, pony, ass, donkey or mule to be exposed for sale in a market, nor permit a mare to be exposed for sale if it likely to give birth there. There are specific requirements concerning the treatment of horses at market, including their handling, feeding and watering, control, and penning. Any foals brought to market must not be separated from their dam.

A person must take such steps, as are reasonable, to ensure the needs of a horse for which he/she is responsible are met to the extent required by good practice. There are specific offences for cruelty. No person shall sell a horse without a passport. On the sale of a horse, the seller shall give the passport to the buyer or, if at an auction sale, the auctioneer shall give the passport to the buyer.
