Food descriptions are generally controlled in Scotland by the Food Safety Act 1990, although some descriptions may also be controlled under other legislation particularly the Consumer Protection from Unfair Trading Regulations. Any information provided must not falsely describe the food, or be likely to mislead as to the nature, substance or quality of the food being served.

The Consumer Protection from Unfair Trading Regulations 2008 also control how prices must be displayed, and require that prices given should not be misleading. The indicated price must be inclusive of VAT and must also show any service charge, cover charge, or minimum charge that might apply. Any conditions for ‘free delivery’ must be stated, and descriptions and prices should be double checked with customers when they are placing an order on the phone.

Many alcoholic drinks must be sold in specified quantities where the drink is to be consumed on the premises. If you trade using any name other than the name of the legal owner of the business, you must disclose the name and address of the legal owner on your premises and on business stationery.
