The Package Travel, Package Holidays and Package Tours Regulations 1992 apply to package holidays which are defined as holidays including overnight accommodation, a combination of at least two of the following; transport, accommodation, and other tourist services, eg car hire, and that are offered at an inclusive price. The Regulations state that ‘the other party’ to a contract with a customer, providing a holiday that is classed as a package, must provide evidence of the arrangements made to secure money to refund customers should ‘the other party’ be unable to complete the contract.
The Consumer Protection from Unfair Trading Regulations 2008 creates offences regarding misleading actions and omissions which will include price indications, facilities and accommodation. There are also Regulations allowing you to challenge unfair/unreasonable contract terms.
There are ways you can ensure your money is protected such as paying on credit card (if the cost is more than £100) to ensure the credit company is jointly liable if there is a problem, and checking bonding arrangements. It is also important to be aware of timeshare deals you may have been persuaded to agree to, and flight only deals.
