(for Scotland)

Buying a car is likely to be one of the largest purchases you will make, so it is essential that you equip yourself with useful information before you go ahead. You should spend time deciding which car is going to suit your requirements, set a realistic budget and shop around. Buying from a trader will cost more but have extra benefits. If things go wrong, you are legally entitled to expect that the car is of satisfactory quality, fit for it’s purpose, as described and roadworthy.
If you have any doubts, or wish to clarify your legal rights in your particular circumstances, you can contact Consumer Direct (new website) for advice. If you buy privately or at a car auction, you need to be extra careful as you will have fewer legal rights if things to wrong. It is essential that you check that the person selling the car really owns it. Internet auctions are different but be aware that you cannot inspect the car beforehand and still have to make a ‘bid’.
There are a number of checks you can make before buying the car including the general condition of the bodywork and tyres, all the relevant paperwork, any discrepancies between mileage figures especially on the MOT certificates, and the written detail in the contract and any finance agreement.
