Enterprise Act in Scotland

A guide for local authority enforcers and solicitors (with amendments).

In March 2001, a consortium of the weights and measures authorities within the Sheriffdom of Tayside Central and Fife, funded by the Department of Trade and Industry, set up a co-operative scheme for dealing with problem traders under the now repealed Stop Now Orders (E.C. Directive) Regulations 2001.

That scheme has been adapted to reflect the provisions of the Enterprise Act 2002 and the relevant orders and a process drafted with supporting background material.

The Project Leader, who bears sole responsibility for the project and for any errors in it, was provided by Fife Council (The Lead Authority), and has at all times had the support of other partners in the consortium. A training programme was devised, has been completed and both trading standards staff and the authorities’ solicitors participated in it.

The guide includes a few amendments of which the most important is set out in page 114 (Time Limits).
