A. Measuring Instruments Directive

In order to reflect additional costs associated with examination, testing and documentation, and maintenance of MID notified body status, certain classes of instrument covered by MID should be subject to additional charges, as follows:

  • Automatic discontinuous totalisers, automatic rail weighbridges, automatic catchweighers, automatic gravimetric filling instruments and beltweighers
  • Cold water meters

B. Special Weighing and Measuring Equipment

Examining, testing, certifying, stamping, authorising or reporting on special weighing or measuring equipment at the place where the service is provided. Such types of equipment, specifically excluded from tables (C) to (I) below, include:

  1. Automatic or totalising weighing machines
  2. Equipment designed to weigh loads in motion
  3. Bulk fuel measuring equipment tested following a Regulation 65 or 66 occurrence under the 1983 Regulations or Regulation 23 or 24 occurrence under the 1988 Regulations
  4. Weighing or measuring equipment tested by means of statistical sampling
  5. The establishment of calibration curves from templates
  6. Templates graduated in millilitres
  7. Testing or other services in pursuance of a Community obligation other than EC initial or partial verification

When testing instruments incorporating remote display or printing facilities, and where completion of the test requires a second person or a second series of tests by the same person, an additional fee may be charged

1. When supplying specialist equipment (including but not limited to weighbridge test unit, van and test weights, etc) an additional fee may be charged hourly, daily or per appointment, according to circumstance.

2. The full fee shall be charged for the first item tested and a discount, of not more than 40%, allowed for each instrument tested at the same time.

3. Reductions at the discretion of the Trading Standards Officer concerned shall be granted for facilities and assistance provided in testing large capacity weighing equipment (i.e. over 1 tonne). In no circumstances shall the reduction exceed 40% of the full fee.

Notes:- There will also be a charge of 25.0p per kilometre (40.0p per mile) for travelling to and from the driver’s base in Kirkcaldy to the location of the hire; Fife Council reserves the right to charge the fee when the hire is cancelled at less than 24 hours notice; Daily rate may be increased by a charge of £69.10 per hour where vehicle and driver are engaged on hire for over 7¼ hours; Where overnight accommodation is necessary, the full cost of this accommodation will be recharged; Where the hire is for a non-working day, an additional charge of £5.98 per hour will apply to the hirer; Fife Council will not be held responsible for any costs or losses whatsoever arising from, or due to, the non availability of the Unit due to circumstances out with our control.

Adjustment Service

The fee for the adjustment of any weight or measure in relation to a service provided under Section 74 of the Weights and Measures Act 1985 shall be equal to the fee for testing it with a view to its being passed as fit for use for trade.

Notes

The charging of a fee may be waived at the discretion of the Head of Service in the case of a request from any person with a justifiable cause to believe that an offence has been committed in respect of the weight or measure of goods supplied to him/her.

Equipment submitted at the Trading Standards offices, or at scalemakers premises, may be allowed a discount of up to a maximum of 40%.

Any verifications, calibrations, inspections or testing carried out at weekends, or on Public Holidays, will be charged at 150% of the normal fee.

VAT

Previous discussions with HM Customs & Excise had concluded that fees, with the exception of those put forward for the purposes of Section 74 of the Weights and Measures Act 1985, were NOT subject to VAT. This is because the work of local authorities was classified as a 'non-business' activity.

However, the situation has now changed. Where applicable, VAT is included in the guidance provided above. See Customs & Excise Notice 749 – Local Authorities and similar bodies (April 2002) for further details. NB This may be subject to further review at any time, but is current at the time of the introduction of these Fees & Charges namely 01 April 2008.
