Counterfeiting

Counterfeit goods are often of inferior quality and sometimes even dangerous. Poor quality fake car parts have been found on sale which could cause a fatal crash if they failed. Counterfeit vodka has been found which contained anti-freeze. 

If you buy fakes and they are faulty, you are unlikely to be able to obtain a refund.

Every year we seize large quantities of pirate goods including music CDs, DVDs of current films, perfumes and sportswear. 

If you are concerned about counterfeiting and want to report counterfeit goods on sale you can use the Rip-off Tip-off website to tell us about it in confidence.

Credit

We are responsible for enforcing the Consumer Credit Act 1974

The Act regulates consumer credit and consumer hire agreements for amounts up to £25,000. Its protections apply to agreements between traders and individuals, sole traders, partnerships and unincorporated associations, but not agreements made between traders and corporate bodies such as limited companies.

It lays down rules covering:

  • the form and content of agreements

  • credit advertising

  • the method of calculating the Annual Percentage Rate (APR) of the Total Charge for Credit

  • the procedures to be adopted in the event of default, termination, or early settlement

  • extortionate credit bargains

The Act also requires that all traders who make regulated agreements obtain licences from the Office of Fair Trading. Credit brokers, debt advisors and others will also require licences.

Markets and Car Boot Sales

We regularly check markets and car boot sales, in particular for:

  • counterfeits

  • unsafe items

  • incorrectly labelled or out of date foodstuffs

Trade Descriptions

We are responsible for enforcing the Trade Descriptions Act 1968

Any descriptions of goods and services, given by a person acting in the course of a trade or business, should be accurate and not misleading.

We make sure that descriptions are true and accurate for all goods and services – from car mileage readings to holiday brochures. We will advise local businesses on their advertising and promotional material prior to publication.

Property Descriptions

We are responsible for enforcing the Property Misdescriptions Act.

It an offence to make false or misleading statements about specified aspects of land (which includes buildings) offered for sale by estate agents or property developers.

Estate Agents can find more information, including guidance on the Estate Agents Act 1979, on the Office of Fair Trading website.

Holidays

We continue to receive a high number of consumer complaints about holidays.

We give advice on holiday problems as well as enforcing the Package Travel, Package Holiday and Package Tour Regulations 1992.

The Regulations cover financial security arrangements which holiday businesses must make, as well as other aspects of the package holiday business, such as advertising, brochures, contracts, surcharge limitations and compensation responsibilities.
