Licensing Act 2003


The Licensing Act 2003 came into effect on the 24th November 2005.

The objectives of the Licensing Act 2003 are;

· The Prevention of Crime and Disorder
· Public Safety
· The Prevention of Public Nuisance
· The Protection of Children from Harm

To achieve these objectives the Licensing department of Oldham Metropolitan Borough Council has 2 strategic aims, which are to;

Promote a Safe and Diverse Night Time Economy

Reduce Crime and Disorder in Licensed Premises and Vehicles


The Act brings into force Personal and Premises Licences together with Club Premises Certificates which between them cover the licensable activities contained within the Act.  They broadly fall within three categories: Retail Supply of Alcohol or supply to a club member, Provision of regulated entertainment and Late Night Refreshment.

Licensing Officers together with Police Officers will be working together to ensure that illegal activities are not taking place through surveillance and visits to premises.  The penalty for carrying out an un-authorised activity is a £20,000 fine and/or 6 months imprisonment.

Licensing Authority- Areas of Responsibility


The responsibilities of the Licensing Authority are in the process of changes as we acquire the licensing responsibilities within the Borough.  At present the Authority is currently responsible for;

· Private Hire Drivers, Vehicles and Operators
· Hackney Carriage Drivers and Vehicles
· Second Hand Dealers
· Sex Establishments
· Greyhound Tracks
· S34 AWP Machines
· Street Collections
· House to House Collections
· Lotteries
· Licensing Act 2003- Premises Licence/ Personal Licences/ Club Premises
· Motor Salvage Operators
· Scrap Metal Dealers
·
Poisons Licences
· Consumer Credit checks
· Street Trading

In the near future the Authority will acquire the licensing responsibilities for;

· Gambling Act 2005 (Casino's, Bingo, Gambling, Betting) - from 2007
 


Licensing Fees Review

 

Oldham Council has completed its submission to Sir Leslie Elton's Independent Review of Licensing Fees.  The review was set up by the Secretary of State for Culture, Media and Sport to:

consider whether the fees cover the full cost to licensing authorities;
identify the scale, extent and nature of any problems encountered by licensees/licence payers and licensing authorities;
make recommendations about how the existing fee structure and levels could be developed and;
ensure best practice is being fully realised across all authorities
