Changing Your Mind - Cancellation Rights
As a general rule your right to cancel a contract agreed by you at your home depends on whether the sales person contacted you first. This includes :

The sales person called on you without an appointment (cold calling)

The seller telephones to ask if they can come round

You invited the trader to do some work after they left a leaflet at your home

If this is the case the following applies :

You may have seven days to change your mind and cancel the contract. You’re also entitled to a refund of your deposit

The seller must give you written details of your cancellation rights (there are limited exceptions to this)

The cancellation rights must be given to you when you agree to have the work done

This should also include a cancellation notice to complete if you change your mind about having the work done

If you cancel the contract and goods have already been supplied, generally you must let the seller come and collect them (some specific exemptions). It’s important to take care of them until this happens


Some exceptions are :

Your cancellation rights are less if you made the first approach to the trader - generally you have no automatic right to cancel unless your contract says so or you bought the goods or services on credit

If goods are installed in a building within the cancellation period you should be able to cancel and may not have to pay for them (see exemptions below)

If a service has been carried out, you may have to pay for it – but this is a tricky area so it’s best to give us a ring for individual advice

You cannot cancel contracts relating to the supply of goods or services costing less than £35, the construction of an extension to a building or perishable goods

When Cancelling
If you cancel, it must be in writing and you should send it by recorded delivery in case you need to prove you have sent it in the future. If possible you should also keep a copy of the cancellation.

Although you have seven days in which to cancel, cancellation should be sent as soon as possible.
