Sales of Aerosol Spray Paints

On 31st March 2004 the Anti Social Behaviour Act 2003 made it illegal to sell an aerosol paint container to anyone under the age of 16, even if they look older.

Aerosol spray paint is often used in acts of graffiti vandalism. By banning the sale of spray paint to under 16's, the Government hopes that the incidence of graffiti will be reduced.

The proprietor of the business, as well as the actual seller, may be prosecuted if a sale to an under-age person is made.

The penalty for this offence carries a maximum fine of £2,500 and Trading Standards Officers are responsible for the enforcement of this law.

A guidance leaflet for retailers is available.
