Tobacco Advertising

Retailers need to be aware about new laws that came into force on 21 December 2004, which strictly controls the amount of tobacco advertising allowed in their shops.

Under the Tobacco Advertising and Promotion (Point of Sale) Regulations 2004, retailers can no longer advertise tobacco products in their premises, other than at the point of sale and any display material will be restricted to A5 size.

Advertising tobacco products on posters in shop windows, or on sandwich boards or awnings outside premises is now prohibited.

It is now an offence to advertise in any way other than within these strictly controlled guidelines, and any advert that is used must include the warning "Smoking Kills " or "Smoking seriously harms you and others around you", as well as the NHS Smoking Helpline number, 0800 1690169.
